The term edible packaging label may be applied to two quite different products cannabis-infused edible, or to a typical packaged food. Both might require a product identity, net quantity, ingredients and allergen information, but an infused product also enters a cannabis paradigm that can include THC information, and government warnings and universal symbols and child-resistant packaging and state-specific limitations.

Classifying, not copywriting is the first task. This guide gives a path of decision between the formula of the product and the physical label. It does not constitute a legal opinion. Prior to making an investment in a sales channel, brands need to confirm the existing federal, state, provincial, and local regulations that govern the particular product and sales channel.

Decision 1: Is It Food or Cannabis-Infused?

Answer with the formulation and market it will be sold in, not the brand name. An ordinary candy like a gummy will tend to be labeled according to food regulations. The regulated cannabis or THC contained in a gummy should also meet the applicable cannabis regime. Another route can be formed by products with cannabinoids derived in hemp and depends on jurisdiction and must not be presumed to adhere to either template.

Document the active ingredients, product claims, intended use, legal sales channel and target locations. Failing to find this route, stop the artwork. Cleaned-up label based on the false categorization is some costly garbage.

No design should be considered as a design-fit, universal edible label until one has checked the legal category of the product, and the market.

Between Statuses 2: Who has the Right to the Label?

Conventional packaged food in the United States may also have requirements of the federal food-labeling to provide identity, net quantity, ingredient statements, major allergens, responsible company information and Nutrition Facts, and has product-specific requirements and exemptions. It might also be subject to state requirements.

The cannabis-infused products are mostly regulated by state cannabis programs in the United States, and by the federal cannabis programs in Canada supplemented by provincial or territorial concerns. The edible can still have some food-related information but the specific demands are not developed by just laying an ordinary Nutrition Facts panel next to a THC icon.

Can add the Cannabis Layer when the Market is known.

In case the edible has controlled cannabis, add the appropriate jurisdiction-specific information. This may comprise a general symbol, standard warning, the amount of THC and CBD ingredient, serving and package counts, batch or tracking numbers, licensee contact and guidelines. Labelling the entire package as a single ordinary snack should not be done when the portion that is regulated makes up a part of the whole package. Employ the uncongesting hierarchy instead of ornamental level graphics, which would be misinterpreted.

Place the Front, Back and Extended Panels.

The main or primary display panel must recognize the product and portray the high priority information needed in the market. Topics like ingredients, allergens, warnings, directions and traceability information may be permitted on other panels. Reserve variable-data areas in which information about production or testing will be appended.

Small formats call for discipline. Solve not all the problems in smaller type. Strip out unnecessary promotional text, make a more appropriate choice of a pouch size or pursue an extended-content format that is in compliance with the law. QR code may contain some educational information but as a rule should not be used instead of physical copy that is required.

Test the package created. A label panel is either a gusseted or a flat file that fits in the back of a product in a transparent window.

Set Change Control Formula-to-Artwork.

Whenever product and packaging changes occur on discontinuous tracks, the edible labels can be incorrect. Ingredients and allergens can be modified with a new sweetener, flavor preparation, colour and oil or coating. Customized serving and nutrition computations can be modified with a new piece weight. The cannabis warning can be modified using a new target state.

Complete a change sheet that will inquire about whether the change is to formula, supplier, allergen, serving, claim, potency, market, package size or closure. In case, the response is yes, then trace the artwork back through the approval concerned.

Have one copy of the deck issued of each SKU and market. The approved file and the revision number should be sent to the printer and not a combination of edits sent through e-mail.
